1. Acceptance of Terms
By downloading, installing, or using Cadence ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
2. Description of Service
Cadence is an AI-powered fitness coaching application that provides personalized training, nutrition, sleep, and recovery guidance based on your self-reported data and Apple HealthKit information.
3. Not Medical Advice
The App provides general wellness guidance only. It is not a substitute for professional medical advice, diagnosis, or treatment.
- Always consult a qualified healthcare provider before starting any exercise or nutrition program
- If you experience pain, injury, or any medical symptoms, seek professional medical attention
- Do not disregard professional medical advice based on information provided by the App
- The App is not designed to diagnose, treat, cure, or prevent any disease or medical condition
4. Eligibility
You must be at least 17 years of age to use the App. By using the App, you represent that you meet this requirement.
5. Account
- You are responsible for maintaining the security of your account
- You are responsible for all activity under your account
- You agree to provide accurate information
- You may delete your account at any time through the App's Settings
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App's systems or data
- Interfere with other users' use of the App
- Submit false, misleading, or harmful content
- Reverse engineer or attempt to extract the source code of the App
7. Intellectual Property
The App and its content, features, and functionality are owned by Cadence and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Data and Privacy
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
9. Apple HealthKit Data
- HealthKit data accessed by the App is used solely to provide personalized coaching
- HealthKit data is never used for advertising or marketing purposes
- HealthKit data is never sold or shared with third parties for non-health-related purposes
- You can revoke HealthKit access at any time through iOS Settings
10. AI-Generated Content
- Coaching responses are generated using artificial intelligence (Anthropic Claude)
- AI responses are constrained by safety rules and readiness engine logic
- AI-generated content may occasionally be inaccurate or inappropriate despite safety measures
- You should exercise your own judgment when following any recommendations
11. Limitation of Liability
To the maximum extent permitted by law, Cadence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
- Physical injury resulting from following coaching recommendations
- Loss of data
- Any health-related consequences
12. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, for any reason, without notice. You may stop using the App at any time.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
